The Homeowners Association Mediation program is designed to provide a time-efficient, convenient, and confidential forum for the resolution of disputes involving Homeowners Associations. Disputes involving association rules and regulations, neighbor relations, construction defects, maintenance, common areas, and fees and assessments are a few of the types of disputes appropriate for mediation.
The Center’s program helps homeowners and homeowners associations take responsibility for resolving their conflicts and forming their own agreements. The resolution of disputes by mediation allows all parties to come away from conflicts with a sense that they have been heard, and that, as much as possible, their needs have been met. This can help build trust, improve relationships, and strengthen the community.
Mediation and other forms of alternative dispute resolution (ADR) are intended to provide efficient, cost-effective, and confidential methods for resolution of homeowners' association disputes.
We mediate disputes with third party vendors such as contractors or architects, and disputes involving the following:
* Members' rights
* Fines, Penalties, Violations
* Artectural Review Committee actions
* Assessments, Dues, etc.
* Voting rights and privileges
* Election to associations
* Third party vendor disputes (contractors, architects)
A mediator works in joint sessions with both parties, facilitating negotiations between two or more parties in conflict, acting as a go-between to ultimately bring parties to a positive resolution. Our mediators offer creativity and personalized experience to clients who wish to avoid the expense and delay of traditional litigation. Your mediator must creatively resolve your conflict in a way that best fits your particular case. Because we practice in areas that complement one another, our clients receive the benefit of our efficient, effective, and creative problem resolution that is so imperative to mediation services.
